Mrs. Hershey, testate of appellee, lived in Independence, Kansas, for a number of years and was a customer of The Commercial National Bank of that city.1 From time to time she purchased real estate mortgages from the bank and from Geo. T. Guernsey, its president. Back in 1923 or 1924 Guernsey assured her that any mortgages sold her would be "first class loans * * * first class in every way." She moved to California...
