The appellant is the administrator of the estate of one A. D. Gaines, formerly resident in Sanger, Oliver county, N. D., who died in July of 1927. The appellee, Wilman E. Adams, is the nephew of the deceased. In 1920 Mr. Gaines delivered about $75,000 worth of shares of corporate stock to his nephew, Mr. Adams, and gave him a conveyance in trust covering the shares of stock, providing that the dividends and proceeds should go to Mr. Gaines...
