This suit is brought under section 4915 of the Revised Statutes, as amended March 2, 1927, c. 273, § 11, March 2, 1929, c. 488, § 2 (b), 35 USCA § 63, for a decree authorizing and directing the Commissioner of Patents to issue a patent embodying the claims in issue to the plaintiff American Tri-Ergon Corporation; the issuance of such patent having been refused by the Commissioner of Patents upon the application of the plaintiffs...
