This is an appeal from a judgment of the District Court dismissing the libel of appellant brought to recover $9,861.71 damages occasioned by failure of appellee to deliver a shipment of 160,000 bushels of corn in as good condition as when received. The defense is that the damage resulted from a "peril of the sea."
