The defendant herein is the duly appointed and qualified acting receiver of First National Bank of Detroit, having been appointed as such by the Acting Comptroller of the Currency on May 11, 1933, and said First National Bank of Detroit closed its doors at the close of business on February 11, 1933, and never thereafter was opened for business.
