The plaintiff instituted this action to recover $7,500 on an accident insurance policy issued on the life of Orlando Halliburton. The insured on October 14, 1931, about 4 o'clock p. m., registered in the Mincks Hotel in the city of Tulsa, Okl., under an assumed name, and was assigned a room on the seventh floor of said hotel.
