This is a suit to recover the full amount of income taxes paid by the plaintiff for the taxable year ending September 30, 1927.

The plaintiff duly filed a return of its income for the taxable period which showed a gross income of $48,622.79 and a net income of $12,259.26, upon which it paid a tax of $1,333.70.
