Wilbur B. Foshay and Henry H. Henley were convicted on counts 1, 3, 4, and 5 of an indictment in 17 counts, charging them and five others, with having devised a scheme and artifice to defraud and to obtain money and property by means of false and fraudulent pretenses, representations and promises, and with having used the mail in violation of section 215 of the Criminal Code (18 USCA § 338).
