This suit is brought by the surety on a guardian's bond to recover the amount it was obliged to pay on account of the defalcation of the guardian, who was also an officer of the defendant bank where the guardian's deposit was kept; the liability of the bank being based on alleged notice of, and participation in, the wrongful handling of the account.
