During an investigation then being conducted by a federal grand jury in the Southern district of New York, relative to violations of section 146 (b) of the Revenue Act of 1928 (26 USCA § 2146 (b), the appellant appeared as a witness and testified before the grand jury on December 3, 1931, and subsequently on the 11th, 14th, and 17th of the same month.
