Appellant Austin F. Teigen is the patentee in letters patent No. 1,554,898 for a "Tobacco Pipe," issued September 22, 1925. Subsequently he assigned a one-fourth interest therein to appellant Bosshard. September 12, 1928, appellants brought suit against appellee charging infringement of this patent, praying injunction, accounting, and damages.
