The Comptroller of the Currency of the United States having found that the First National Bank of St. Petersburg, Fla., was insolvent and unable to pay its just and legal debts, plaintiff herein was, by said Comptroller, appointed receiver of said bank, on June 9, 1930. Subsequently plaintiff brought this action against the defendant herein to recover the assessment levied upon that portion of the stock of said bank, of which plaintiff alleges...
