Since the beginning of this case, the plaintiff has asked leave to amend his petition by changing the title of the plaintiff from simply "John M. Kroyer" to "John M. Kroyer, for the use of himself and of Fidelity & Casualty Company of New York, a corporation, as the interest of each may appear." This motion has been granted, but for reasons that will hereinafter appear we have concluded that this change does not affect the decision in the case. For...
