The appellee was the owner of a distilling plant in St. Louis, Mo. He was also the owner of practically all of the capital stock of the Jack Daniel Distilling Company, which had the plant under lease. In June of 1923 he sold the stock of the distilling company to George Remus and his associates. At the same time he canceled the existing lease on the plant and executed a new one with the company under its new ownership. This lease ran for one...
