Appellant brought this suit against the appellee for infringement of patent No. 1,725,787 issued to George H. Ellis August 27, 1929. For convenience the parties will be referred to as they appeared in the lower court.

The bill of complaint is in conventional form, alleging the issuance of the patent, its assignment to the plaintiff, the acts of infringement by the defendant to plaintiff's damage, and the prayer for permanent injunction...
