Appellant, herein called plaintiff, sued the executrix of the will of Holden, a former collector of internal revenue, to recover an overpayment of income and profits taxes for the year 1922. The foundation for the suit laid in the original declaration was the general allegation that plaintiff was entitled to additional deductions for depreciation in the years 1921 and 1922.
