Appellants were charged by the indictment in the District Court with having engaged in a conspiracy to violate the National Prohibition Act. Conviction of the offense was followed by judgments of imprisonment. During all of the time that the alleged conspiracy continued, appellant Weniger was the sheriff of the county of Shoshone, in the state of Idaho, and appellant Bloom was a deputy sheriff in the same county.
