This is an action to recover on a war risk insurance policy. Upon stipulation of parties it was tried by the court without a jury. The plaintiff enlisted in the United States Navy March 16, 1917, and served until August 25, 1919, when he was honorably discharged. A war risk policy in the sum of $5,000 was issued to him under date of February 12, 1918. May 22, 1919, plaintiff, by instrument in writing, requested the cancellation of the policy...
