On the 16th day of April, 1928, there was filed in the superior court of Marion county, room 2, at Indianapolis, Ind., a suit by Banus E. Neal against the Knox Consolidated Coal Company, which suit was filed by Neal as a stockholder in such coal company (which is hereinafter designated as the company) and as a holder of bonds issued by it.
