This is the case of a directed verdict. The facts are not in dispute. The analogue is in consequence that of a special verdict of the jury finding the facts and asking the trial court to mold the verdict for the plaintiff or for the defendant as the law arising out of the facts as found dictates. The court accordingly directed a verdict for the plaintiff. The question thus becomes one of law as if upon a case stated.
