KENYON, Circuit Judge.

This is an action brought by appellee to recover certain war risk insurance granted him by the government while he was in the military service of the United States in the World War. Said insurance was for $10,000, payable in the sum of $57.50 each month in the event of his becoming totally and permanently disabled during the time the same was in force. He was discharged from the Army on May 8, 1919. Premiums were paid to cover the month of discharge...
