This is a civil action for the recovery of damages for the death of plaintiff's intestate, Fred Grant, alleged to have been caused by the negligence of the defendants, Jupollo Public Service Company and Utilities Engineering & Construction Company. The action was begun in the superior court of McDowell county, N. C., and on petition of appellants was removed to the District Court of the United States, at Asheville, where it was tried...
