Plaintiff brings this action upon a $10,000 policy of war risk insurance, and alleges that he became totally and permanently disabled during the time it was in force. Defendant demurs to the amended complaint, and asserts that as the complaint shows that on July 1, 1927, plaintiff converted the original policy into a five-year life insurance policy, his rights, if any, are on the converted policy and not on the original policy.
