Appellant has appealed to this court from a decision of the Commissioner of Patents, affirming the decision of the Examiners in Chief, which in turn affirmed the decision of the primary examiner, denying patentability to claims 9, 10, 11, 12, and 13, of which claims 9 and 10 are representative and follow:

"9. In combination, an automobile bumper comprising a horizontal bar and a plurality of upright shoes adjustably fastened thereto...
