At the November term, 1928, of the District Court of Maine, on November 9, 1928, an indictment was returned against the defendant, Flynn, and three persons named Nolan, Daley, and Delano, charging that, during the period from April 1, 1928, to September 25, 1928, they had unlawfully and feloniously conspired together to violate section 3, title 2, of the National Prohibition Act (27 USCA § 12).
