PARKER, Circuit Judge.

This was an action at law instituted by Julia A. Sellars against the Continental Life Insurance Company to recover on a policy of life insurance issued upon the life of her deceased husband. The defense was that the policy had lapsed. At the conclusion of the testimony verdict was directed for defendant, and plaintiff has appealed. We shall refer to the parties in accordance with the positions occupied by them in the court below.
