These two cases grow out of one suit, originally instituted in the United States District Court for the Northern District of Oklahoma by W. D. Hawker, appellant, plaintiff in error, against H. F. Worley, appellee, defendant in error, to recover $5,000, the alleged difference between the price for which the latter as broker actually sold an oil and gas lease for plaintiff, and what he represented the price to have been.
