COTTERAL, Circuit Judge.

The plaintiff in error and a codefendant, Silas Miller, were convicted on the third count of an indictment which charged them with violations of section 215 of the Penal Code (18 USCA § 338). The grounds urged for reversal are that the trial court erred in sustaining the indictment, admitting and excluding testimony, and refusing to give instructions to the jury.
