This is an appeal from a decision of the Commissioner of Patents denying registration of a trade-mark to the applicant, now the appellant.

On December 27, 1924, the applicant, Katz Underwear Company, filed an application for the registration of a trade-mark consisting of a representation of a cat's head on a circular background for use on textile underwear for ladies, alleging continuous use of the mark on such goods in applicant's business...
