The bill of complaint alleges that Henry Meyer died in 1905, a resident of Denver, Colo., leaving three children, a son, Philip A. Meyer, for whom the plaintiff has been appointed conservator and a committee of his estate, because of his incompetency, and another, Hugo R. Meyer, who has since died, and of whose estate the defendant Charles Coleman Beard has been named ancillary executor cum testamento annexo.
