DENISON, Circuit Judge.

Plaintiff's decedent was killed by a railroad train within the city of Greeneville, Tenn., and in this action plaintiff recovered damages therefor. The train was going into the city from the east. At a point a quarter of a mile east of the station the tracks are crossed by Rankin street. For a considerable distance in both directions there is a passing track parallel to the main track, the near rails of the two tracks being nine feet apart...
