THOMAS, District Judge.
On October 24, 1922, the Patent Office issued to C. P. Randolph a design patent on an electric waffle iron, upon an application filed March 13, 1922. This patent was assigned to the plaintiff corporation which brings this suit and charges the defendant with infringement. The defenses are invalidity and noninfringement, if the patent is held to be valid.
