The appellant, plaintiff below, contracted with the city of Tulsa to excavate and lay a water conduit from what is known as Spavinaw Lake to Tulsa. The entire job was divided into 20-odd contracts, two of which, numbers 4 and 6, were awarded to appellant, and comprise the major portion of the project.
