Plaintiffs were the owners of a large tract of timber land in Washington county, Mo. In March, 1920, J. W. Beck of Olney, Ill., a sort of a lumber broker, learned that plaintiffs wished to sell some lumber. He called on plaintiff Milton at East St. Louis, where the latter was engaged in the live stock business, and arranged to go to Missouri, ostensibly to see the timber and to talk with the other partner, Mr. Bass.
