BOOTH, Circuit Judge.

This is a proceeding seeking a review of an order of the Board of Tax Appeals which redetermined a deficiency in the income tax of the Kendrick Coal & Dock Company for the year 1920. The proceeding in its initial stages was called a petition for review, later an appeal. The order of the Board of Tax Appeals fixed the deficiency of the tax at $18,804.01, the same amount as found by the Commissioner of Internal Revenue.
