BRYAN, Circuit Judge.

Chin Hing, a person of Chinese descent, was ordered deported by a United States commissioner on the grounds that he was a Chinese laborer and had unlawfully entered the United States. He appealed to the District Judge, who affirmed the order of the commissioner, and he now appeals to this court.
