Louis Pepe has been ordered deported, and he sues out this writ of habeas corpus to test the validity of the order of deportation.

By a stipulation entered into between counsel it is conceded that the petitioner entered this country from Italy on March 15, 1911, and that he is still an alien. The stipulation then recites that:

"(3) On July 14, 1925, said petitioner appeared in the superior court at New Haven county and was found...
