The United States brings this action against the Spokane International Railway Company to recover penalties for alleged violations of the Federal Safety Appliance Acts (45 USCA § 1 et seq.). Three counts are embraced in the complaint, which were, after the overruling of the demurrer, submitted to the court upon an agreed statement of facts without the intervention of a jury.
