The plaintiff, by the present action, seeks to recover the sum of $1,515.25, with interest, the principal amount being the total of certain payments alleged to have been wrongly exacted from plaintiff by defendant as capital stock taxes due the United States for the taxable period years ending June 30, in the years 1919 to 1925, each inclusive. The case was heard by the court without a jury.
