Some months prior to February 19, 1927, the Oregon Construction Company entered into contracts with the cities of Grants Pass and Klamath Falls, in the state of Oregon, for the construction and laying of sewer systems for the two cities, and the Independence Indemnity Company executed surety bonds on behalf of the contractor for the faithful performance of these contracts.
