This is a motion by the plaintiff for leave to amend his declaration. The original declaration was filed June 28, 1921, to recover damages alleged to have been caused to the plaintiff by the infringement by defendant of two certain patents owned by the plaintiff. The sixth paragraph of said declaration was as follows:

"That the said letters patent were issued to your plaintiff and inventor for a period of seventeen (17) years, which...
