This is an action under the Federal Employers' Liability Act (45 USCA §§ 51-59; Comp. St. §§ 8657-8665) to recover damages for personal injuries sustained by a brakeman in the employ of the defendant railway. Plaintiff concedes that this court has no jurisdiction of the action, and that it should now be dismissed, unless the injuries were sustained in interstate commerce. The case was
