The plaintiff in error, hereinafter referred to as the defendant, was indicted in two counts with one Fred Gladfelter for conspiracy to violate the National Prohibition Act (Comp. St. § 10138¼ et seq.) to possess, transport, and sell intoxicating liquors, and for selling intoxicating liquors. The first count charged the conspiracy, and the second count selling intoxicating liquors.
