Sautbine sued Stroud for damages for breach of a contract to sell certain corporate stock. This contract was evidenced by certain telegrams which passed between the brokers who made the sale and Stroud, the alleged seller of the stock, together with the brokers' seller's note, signed by the brokers and by Sautbine the buyer.

The case was here before on a writ of error, brought by Sautbine, to reverse a ruling of the District Court, sustaining...
