This is an action brought by the consignee of a carload of coal against the railroad company which had undertaken to transport the coal. The amount of the shipment was 88,700 pounds. Of this amount 5,500 pounds were lost in transit. The destination was Minneapolis, Minn., and the delivery was on an industry railway track running alongside of or into plaintiff's coal yard at that place.
