This is an action at law to recover taxes paid to the United States under protest. By stipulation of the parties, a jury was waived and the case tried to the court.

The claim of the plaintiff is that the Commissioner of Internal Revenue has wrongfully assessed and exacted a tax for the transportation of its iron ore in its own vessels on the Great Lakes; that this was done by the Commissioner under the alleged authority of the Revenue...
