Defendant in error, a Delaware corporation, brought this action in May, 1926, to recover from the Board of County Commissioners of Montrose County, Colorado, and Goldsmith, County Treasurer, parts of the gross amounts which it was required to pay as taxes, interest, cost and penalties levied on and charged against its properties, real and personal, in that county for the years 1923, 1924 and 1925.
