Appellee, called plaintiff, as successor in trust to Gold-Staback Company, called Company, was given a decree against appellant, called defendant, for trust funds, placed by the Company in defendant's bank in a general checking account, and appropriated by defendant in payment of the Company's notes, when the Company became insolvent.

The Company, at Minneapolis, had long done a loan business....
