Plaintiff in error was convicted in the court below of the crime of perjury. The indictment charged that plaintiff in error on the 21st day of June, 1917, filed in the land office at Ft. Sumner, N. M., an application to make homestead entry under the Act of February 19, 1909, on the S. E. ¼ of section 9 and the S. W. ¼ of section 10, in township 3 south, range 23 east, N. M. P.
