Upon rehearing, the plaintiff brings to our attention two cases decided by the Court of Appeals of New York, which neither party cited at the first argument, and which we did not discover for ourselves, perhaps because they do not cite Isenberg v. Rainier, 145 App. Div. 256, 130 N.Y.S. 27. These are Klotz v. Angle, 220 N.Y. 347, 116 N. E. 24, and Hanna v. Stedman, 230 N.Y. 326, 130 N. E. 566, and they seem to us conclusively to construe section...
